How to Hire Your First Employee Without an HR Team
An appointment letter is now legally mandatory, ESI kicks in at ten people and PF at twenty. Everything a founder needs to do before employee number one starts, in order.
Hiring your first employee is the point where a project becomes a company. It is also where founders discover that a WhatsApp message saying "welcome aboard, ₹8 lakh, start Monday" is not an employment contract.
None of this needs an HR person. It needs about half a day and the right order of operations.
Before you post the role
Write down what this person owns. Not a list of skills, a list of outcomes. "Own our customer support queue and keep first response under two hours" tells a candidate more than any three paragraphs about a fast paced environment.
Decide the number before you meet anyone. Fix a range for the role and stick to it. Deciding salary after you fall for a candidate is how you end up paying employee one more than employee four, which you will still be untangling three years later.
Decide employee or contractor, honestly. If you set their hours, give them a laptop and direct their daily work, they are an employee, whatever the invoice says. Misclassification is a PF and tax problem later, not a clever saving now.
The offer, and then the appointment letter
The offer letter is short: role, salary structure, start date, reporting line, probation, and how long the offer stands. The appointment letter, issued at joining, is the real document.
Since the four labour codes came into force on 21 November 2025, issuing an appointment letter is mandatory for every worker. It is no longer optional politeness.
Your employment agreement needs, at minimum:
- Salary breakup, with basic, allowances and any variable pay spelled out
- Probation length and notice period on both sides
- Confidentiality
- Intellectual property assignment. Without this, code and designs your employee writes may not clearly belong to the company. Investors check this during diligence.
- Leave policy, working hours and place of work
- Grounds for termination
Get a lawyer to draft the first one. It costs ₹10,000 to ₹25,000 and you will reuse it for every hire after.
The registrations, in the order they hit you

Note that ESI arrives at ten people and PF at twenty, so a growing team crosses these lines in that order, usually without noticing. Both were folded into the Code on Social Security, and central and state rules are still being notified, so check the current position with your payroll consultant.

Set up payroll before day one, not after
You need to be able to do four things every month: calculate the salary, deduct TDS, pay it on the same date each month, and issue a payslip. Doing this in a spreadsheet works up to about five people. Past that, payroll software costs a few thousand rupees a month and removes a category of mistake you cannot afford with people's salaries.
Whatever you use, pay on a fixed date. Nothing damages trust in a small company faster than a salary landing two days late with an explanation.
The first week
- Laptop, email and the tools they need, ready on day one. Not "we will sort it by Wednesday".
- Signed appointment letter and IP assignment on file, along with their PAN, Aadhaar and bank details.
- Written expectations for the first 30, 60 and 90 days.
- A weekly one to one in the calendar, recurring, from week one.
- Someone to have lunch with. Employee number one in an empty office is a lonely job.
What founders get wrong
Hiring a junior person for a job that needs judgement. Employee one usually works with very little supervision. Pay for experience if you cannot supervise.
Skipping probation. Three to six months, written down, used honestly. It protects both sides.
Promising equity casually. A verbal "you will get 1%" with no ESOP pool, no vesting and no paperwork ends in resentment. Either do it properly or do not say it.
Labour rules are mid transition after the new codes, and state rules are still coming. Confirm anything with money attached to it with your CA or payroll provider before you act.
